Expert Discussion on Trade Negotiations, Free Trade Agreements, and Constitutional Review in Indonesia

A focused expert discussion was held to examine the relevance of implementing Constitutional Court Decision No. 13/PUU-XVI/2018 in assessing the legal and regulatory implications of recent trade developments, including the impact of Trump-era tariff negotiations and other free trade agreements on Indonesia’s domestic legal framework. The discussion took place on Tuesday, 25 November 2025, and was organized by Koalisi Masyarakat Sipil untuk Keadilan Ekonomi, in collaboration with the Center for International Law Studies.

The discussion featured contributions from Hadi Rahmat Purnama and Rizky Banyualam Permana, who explored how contemporary trade negotiations and free trade agreements increasingly extend beyond tariff issues to affect regulatory autonomy, public participation, and constitutional principles.

The session highlighted concerns regarding the transparency of trade negotiations, the scope of government commitments undertaken outside formal ratification processes, and the growing relevance of Constitutional Court jurisprudence as a mechanism for public oversight. In this context, the discussion emphasized the importance of aligning trade policy decisions with constitutional requirements, democratic accountability, and Indonesia’s broader economic and social objectives.
